Semi Truck Incidents
We all worry about being hit by a Semi-Truck when we pass them on the road. This is natural to have this fear. They are obviously larger than the average vehicle, they have a lot more wheels involved, and they can cause far more damage at slower speeds than the average personal vehicle can. Because of these extra risks, truck drivers in these big rigs have to take extra care as they are legally obligated to go through extensive extra training prior to operating a semi-truck commercially. These drivers have a higher duty to be careful on the road, but so do the cars around these big rigs.
Unfortunately, even when we take the utmost care, collisions still occur, and it’s our role at Johnson Livingston to educate about ways to be careful and cautious around semi-trucks, as well as represent you if you unfortunately are involved in a semi-truck incident.
Should I get a Personal Injury Attorney for a Semi-Truck Incident?
Yes. Hiring a personal injury attorney after a semi-truck incident is highly recommended. Oftentimes these semi-truck drivers have conflicting requirements and expectations: they have federal regulations on things like the amount of drive time per day or how much weight they can be hauling, but they also have to work for bosses and companies that want these hauls to be done quickly, and sometimes these factors contradict one another, compromising the safety of driving these big rigs. Considering all these factors is important to building a case; assessing where negligence played a part is key to a successful case.
If you’re ever involved in a semi-truck incident, the sooner you hire a personal injury attorney, the better. At Johnson Livingston, we have seen greatest success when we begin working with you right after your incident occurs. A large part of this is ensuring that we have timely access to things like surveillance footage, witness accounts and more. We are accustomed and well-equipped to collect this vital information, and we can do so promptly to help aid in your case. Already been in a semi-truck incident? We recommend contacting an attorney as soon as possible.
What to Do if You’re in a Semi-Truck Incident
1. Call 911
If you are able to, call 911. Semi-truck incidents can result in injuries or a damaged phone, either of which may inhibit you from being able to call 911. If you see a witness, ask them to call 911. And if you are a witness to a semi-truck incident or drive by after an accident has happened, immediately call 911 to report what you see as the driver may not have been able to call.
If you are involved in a semi-truck incident, you will want to file a police report to have the accident on record. When calling 911, request emergency services so you can be medically evaluated. After an incident is not the time to be tough or say that you are fine. If you are feeling any pain, discomfort or have any scratches or bruising, you will want this to be included in the report as it is more difficult to tie any injuries or damage back to the accident if you are medically treated by a doctor at a later time or date.
Obtain your copy of the police report once it is available or have your personal injury attorney acquire your copy as this report and any evidence that is collected on the scene will be necessary for your case.
2. Get Contact Information of any Witnesses
If possible, get the name and phone number of any witnesses to your incident. While we understand this may be difficult or impossible due to injury, if at all possible you will want to be able to get the testimonies of what bystanders saw during the collision.
3. Seek Medical Attention
Even if it feels like a minor cut, scrape or bruise, make sure that any pain or marks that have resulted from the crash are documented by the police/EMTs so that they are on record.
4. Take Photos
This is not the time for selfies, but rather this is the time to take any photos of damage to your motorcycle, damage to other vehicles involved, the surrounding area and anything that may have resulted in the motorcycle incident such as potholes, black ice, etc.
5. Schedule a Free Consultation with a Personal Injury Attorney
Finding the right personal injury attorney to represent you is important for you to feel comfortable and to get the best result out of your case. It is our top priority to make sure that you are taken care of, understand your rights, and are equipped with the knowledge to make the right decisions for yourself when hiring a personal injury attorney. How to Prevent a Semi-Truck Incident
Stay Attentive and Vigilant on the Road
There are lots of distractions when driving, whether it be cell phone usage, tinkering with the radio, or even other passengers in the vehicle with you, but you should always be vigilant and attentive on the road, especially when driving near a semi-truck. Always be mindful of blindspots, both yours and semi-trucks. Many trucks have signage reminding other cars about how if you can’t see their mirrors, they can’t see you, so be sure to keep this in mind when you’re driving next to or passing a semi-truck. Double and even triple check if you have to before passing a semi-truck.
Another safety concern to be aware of is wind. Oftentimes the back trailer of a semi-truck might swerve within the lane if there are large enough gusts of wind; be on the lookout for this occurrence and take proper space and care.
Remember to Maintain Proper Following and Passing Distance
These large rigs can have anywhere between 10 and 18 gears and are pulling a lot of weight, which means they have a slower reaction time and can inflict greater potential damage, even at a slower speed. If you cut off someone in a regular sedan, they might be able to stop, but a semi-truck very well might not be able to stop in time. Be sure that you’re providing ample time AND space between you and a semi-truck driver prior to passing or moving into the lane the semi-truck is in. Also ensure that you’re following behind semi-truck drivers at a safe distance (at least three car lengths).
It sounds like a no-brainer, but driving as responsibly as possible is important to show that you are doing your part to be a safe driver. If you are involved in a semi-truck incident, showing that you did everything you could to protect yourself and others will be helpful for your case.
